This course will cover these topics:
1. Introduction to immigration law: international law and sources. Principles of natural justice and applied administrative law in the immigration context. Appeals and reviews: an introduction.
2. Immigration law and citizenship (the statutory context). The Immigration Regulations and Immigration Instructions: an introduction. Where to source information to advise clients intending to apply for a visa of the requirements.
3. Immigration advice regulation and ethical issues. Advisers and lawyers.
4. New Zealand citizenship: deprivation and special cases. Adoption. Problems involving the children of citizens by descent: tangata whenua born in Australia. Excluded persons: section 15. Special directions and special circumstances.
5. Specific problems in the interpretation of Immigration Instructions: temporary and residence class visas. Residence appeals. Deportation liability and deportation. Temporary visa holders. Tribunal appeals.
6. Tribunal appeals: deportation of residents: problems and principles that apply. Crossovers with immigration law: criminal, family, employment, civil.
7. High Court cases including judicial review, appeals on a point of law and leave requirements. Important Court of Appeal and Supreme Court cases not yet considered.
8. An introduction to refugee and protection law and appeals. The application of international refugee law: an introduction only.
